PA - What is the procedure after foreclosure sale for removal of previous occupants personal belongings?
After having the winning bid on a sheriff sale of a property, the previous occupant, who does not live there, has a bunch of stuff at same said foreclosed property and is being lazy in removal. Currently, the sale is in the 10 day "Objection Period" and will have deed shortly thereafter. Don't get me wrong, I do want the individual to have his property, less work for me to do, but I do not want to be taken advantage of either as his laziness will be holding up progress for the overhaul of the residence. Occupier stated to me he had 30 - 90 days to move, which did not sound right. Anybody have any idea in how to deal with this situation? Thank you. Lynn

- In PA, you're going to have to go to the district magistrate's office and get an eviction notice. The tenant does not get 90 days to move. Talk with the attorney who is handling the real estate transaction to get legal advice.
- Buying the home with someone in it makes them your tenant according to the law. You will need to file for an eviction. Depending on where in Pa they can take as long as 90 days or as little as 30 days. Once you have the eviction you will need to get writ of possession. This usually takes about 14 days to go through. If at the end of this stage the tenant is still there you will need to get the local sheriff to put them out. I suggest you have a locksmith come with you to change all the locks at this point in time. At that point the tenant has the option of either 1 - moving all their stuff out right then and there or 2 - leaving and coming back to get their items. If they choose to leave their items there then you are on the hook for holding them for 30 days. You can rent a storage unit and pass the cost on to the tenant or you can just leave it in the property. Your choice. All in all it will be around 4 or 5 months before you are completely done with the tenant. Good Luck!
