If a company includes my resume in their bid for a government contract, do they have to offer me a job?

A company contacted me requesting to utilize my resume in a proposal they wanted to submit to the government. The requirements were that the contractor needed to prove they have competent and qualified individuals to do the scope of work. If that company neglects to offer me the opportunity to work on the contract once they won the award, do I have a case to sue?

  1. No, just because they are proving that they have a number of qualified people to do the contract doesn't me they have to automatically hire anyone. And FYI, an employer doesn't have to hire everyone who is competent enough to do ANY job. You can't sue someone because they don't hire you or offer you an opportunity to work on a project.
  2. No, because there was never a formal offer. They were just proposing that you be utilized, but if they found someone else then that's their decision. You were never "offered" the position so you have no legal leg to stand on.
  3. I disagree with the previous 2 answers. If your qualifications helped them win the contract, you should be offered an incentive such as a job or bonus. After all, they are saying in their bid "we have an individual or individuals on our staff that have this skill-set and can get the job done" then the govt is looking at your skills to help them make a decision. When the contractor asked your permission, it is implied that you'd be considered for the position. Think about it, your not going around letting people use your face on their advertisement for free........win-win situation......a job or sue them.
  4. No, you are not the party who was harmed by the use of your resume. That would be the government who was led to believe something that was not true. Perhaps you might earn a pittance by blowing the whistle but mostly chalk this one up to experience. A lesson learned those who would cheat others will also cheat you.
